[por] Analisa a trajetória da previdência brasileira, desde a criação das Caixas de Aposentadorias e Pensões (CAPs) e Institutos (IAPs) até a configuração da Seguridade Social na Constituição de 1988. Investiga-se a transição da “cidadania regulada” para o modelo de proteção universal (mitigado pelo caráter contributivo). O foco recai sobre a guinada neoliberal e o viés fiscalista das reformas recentes, especialmente a EC nº 103/2019. Argumenta-se que a adoção da lógica do Estado subsidiário desmonta o sistema solidário, precariza o trabalho e enfraquece a proteção aos riscos sociais, desafiando a fundamentalidade do direito à previdência.; [eng] This paper analyzes the history of Brazilian social security, from the creation of Retirement and Pension Funds and Institutes to the establishment of Social Security in the 1988 Constitution. It investigates the transition from “regulated citizenship” to a universal protection model (mitigated by its contributory nature). The focus is on the neoliberal shift and the fiscal bias of recent reforms, especially Constitutional Amendment No. 103/2019. It argues that the adoption of the subsidiary state logic dismantles the solidarity-based system, makes employment more precarious, and weakens protection against social risks, thereby challenging the fundamental nature of the right to social security.
