Com a evolução da legislação, há independência e autonomia, inclusive conceitual, entre empresário e empresa, pois cada um tem sua vida independente, mesmo diante da ligação formal do empreendimento que os mantém conectados. Cumprir a função social da empresa, a médio e longo prazo, traz benefícios como reconhecimento e projeção no mercado de trabalho. A cogestão tem previsão na legislação brasileira e origem no direito estrangeiro, podendo ser uma forma de tornar efetiva a função social empresarial. Entretanto, por não ser algo impositivo na lei, nem haver incentivos imediatos pelo uso do instituto, pouco se aplica nas relações de emprego no Brasil.; [eng] The concept of the company’s social function is implicit in the concept of the social function of property, a right and a duty imposed by the Federal Constitution, which is widely observed in the sphere of private law, given the regulations of the Brazilian Civil Code. On the other hand, when the private agent, as an entrepreneur or company, sets out to fulfill the social function, it preserves its primary interest of generating profit. With the evolution of legislation, there is independence and autonomy, including conceptual autonomy, between the entrepreneur and the company, since each one has their own independent life, even in the face of the formal link of the enterprise that keeps them connected. Fulfilling the company’s social function, in the medium and long term, brings benefits such as recognition and projection in the job market. Co-management is provided for in Brazilian legislation and originated in foreign law, and can be a way of making the corporate social function effective. However, because it is not required by law, nor is there any immediate incentive to use the institute, it is rarely applied in employment relationships in Brazil.
