Conclui que individualmente o empregado não pode dar quitação ao vínculo empregatício sem participação sindical, preservando o caráter coletivo da negociação. O método dedutivo, a revisão literária, a interpretação normativa e a análise jurisprudencial foram utilizados na pesquisa.; [eng] This work examines the free stipulation of matters by hypersufficient employees in relation to the legislation, highlighting its prevalence, even when it implies the reduction of rights. It addresses the concept of the hypersufficient employee introduced by Law 13,467/2017, highlighting the conceptual fragility of assuming their lack of vulnerability. The study highlights the dependence of this employee on the employer, contradicting the principle of equality. It analyzes the matters that can be stipulated by the labor union and the hypersufficient employee, in addition to the position of the Federal Supreme Court. It concludes that individually the employee cannot settle the employment relationship without labor union participation, preserving the collective nature of the negotiation. The deductive method, literary review, normative interpretation and jurisprudential analysis were used in the research.
